These Terms of Service (“Terms”) govern your access to and use of Ponchos. By creating an account or using Ponchos, you agree to these Terms.

1. What Ponchos is

Ponchos is an informational and research tool that helps you evaluate companies as potential places to work, using public information about companies (funding, hiring activity, developer activity, and similar signals) combined with preferences you provide about what you’re looking for.

Ponchos is informational only. Ponchos does not guarantee the accuracy, completeness, or currentness of any company information, score, evaluation, or research output it shows you, and does not guarantee any job, interview, offer, or employment outcome. Company evaluations and match scores are generated using automated methods, including third-party AI services, and may contain errors or be based on outdated source information. You should independently verify anything important before making a career decision based on it.

2. Account access

Ponchos access is currently invite-only or subject to founder approval. We may grant, decline, suspend, or revoke access to Ponchos at our discretion, including for violation of these Terms, misuse of the product, or abusive behavior. You are responsible for keeping your account credentials confidential and for all activity under your account.

3. Third-party job listings and links

Job listings shown in Ponchos link directly to the employer’s own site or applicant-tracking system. Ponchos is not the employer, is not a party to any job application or hiring decision, and is not responsible for the accuracy, availability, or content of any third-party site or listing. Job postings may be outdated, filled, or removed without Ponchos’s knowledge.

4. Acceptable use

You agree not to:

  • Use Ponchos for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to Ponchos, other accounts, or its underlying systems.
  • Scrape, systematically extract, or resell Ponchos’s data or outputs without permission.
  • Interfere with or disrupt the operation of Ponchos.
  • Misrepresent your identity or share your account access with others.

We may suspend or terminate access for anyone we believe is violating these Terms or misusing the product.

5. Credits and payments

Ponchos does not currently process payments. Any credits shown or granted in the product are an internal bookkeeping mechanism, not a purchased service, and carry no cash value. This may change in the future, in which case these Terms will be updated.

6. Intellectual property and sourced material

Ponchos displays information sourced from public company data, public job-board APIs, public GitHub data, and content generated using third-party AI services based on that public information. Underlying third-party data remains the property of its respective owners. Ponchos’s own product, design, and generated analysis are our intellectual property. You may not copy, redistribute, or create a competing product from Ponchos’s outputs without our permission.

7. No warranty

Ponchos is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that Ponchos will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the fullest extent permitted by law, Ponchos and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of income, opportunity, or employment, arising from your use of or reliance on Ponchos, including any career or job-search decision made in connection with information Ponchos provided.

9. Termination

You may stop using Ponchos at any time. We may suspend or terminate your access at any time, with or without cause. Sections of these Terms that by their nature should survive termination (including intellectual property, no warranty, and limitation of liability) will survive.

10. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles.

11. Changes to these Terms

We may update these Terms as the product changes. We will update the “Last updated” date above when we do. Continuing to use Ponchos after a change means you accept the updated Terms.
