Terms of Service

1. What Ponchos provides

Ponchos is an informational career-research service that helps users discover and evaluate companies and roles. It combines preferences you provide with public and licensed information about companies, funding, hiring, developer activity, and professional or workforce changes. Features may include recommendations, scores, Watchlists, alerts, research narratives, People Intelligence, and AI-generated explanations.

Ponchos is informational only. Ponchos is not an employer, recruiter, investment adviser, financial adviser, or employment agency. It does not guarantee the accuracy, completeness, or currentness of any source, profile, listing, observation, score, recommendation, or generated output, and it does not guarantee a job, interview, offer, compensation, equity value, or other employment outcome. Automated methods and third-party AI can make mistakes. Verify important information independently before making a career or financial decision.

2. Eligibility, beta access, and accounts

You must be legally able to enter into these Terms. If you use Ponchos for another person or organization, you represent that you have authority to bind them. Ponchos is currently a private beta: account creation does not guarantee product access, which may remain subject to invitation or approval.

You must provide accurate account information, keep credentials secure, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account. You may not share, transfer, or sell access to another person.

3. Plans, beta features, and service changes

Ponchos may provide Standard, Pro, trial, complimentary, early-access, internal, or other access levels. Features, limits, eligibility, and availability may differ by account and may change as the beta develops. A plan label or access grant is not a promise that a particular feature will remain available indefinitely.

We may add, change, suspend, test, or discontinue features and may impose reasonable limits to protect service reliability, provider capacity, or other users. When a change materially affects an existing paid commitment, any additional rights stated at purchase or required by law will apply.

4. Your information, content, and submissions

You retain any rights you have in information you submit, such as your Search Profile, background summary, notes, feedback, and company requests. You give Ponchos a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, and display that information only as reasonably needed to operate, secure, support, personalize, and improve the service as described in the Privacy Policy.

You represent that you have the right to provide what you submit and that it does not violate law or another person’s rights. Do not submit sensitive personal information that Ponchos does not request. Suggestions and product feedback may be used without restriction or compensation, but we will not publicly identify you as the source without permission.

5. Public information, People Intelligence, and corrections

Public professional and workforce observations may be incomplete, stale, duplicated, or attributed incorrectly. They are not an authoritative employee directory or verified headcount. Ponchos may label, restrict, correct, or remove information when it learns that the information is unreliable or receives a valid request. Privacy or correction requests may be sent to the contact address below.

6. Third-party listings, services, and links

Job listings and other links may lead to employer sites, applicant-tracking systems, or other third parties. Ponchos is not a party to an application or hiring decision and is not responsible for third-party content, availability, security, terms, or privacy practices. Your use of services such as Google sign-in is also subject to the applicable provider’s terms.

Public YouTube channel statistics and most-watched public video metadata displayed in Ponchos are provided through the YouTube Data API Services and remain subject to the YouTube Terms of Service. Ponchos-calculated changes, growth percentages, and view-count rankings are identified as Ponchos product metrics and are not supplied by YouTube.

7. Communications

We may send service messages needed to confirm or secure your account, administer beta access, or communicate material service or legal changes. Optional product digests are sent only when enabled for your account and can be disabled through the available preference or unsubscribe control. You remain responsible for keeping your email address current.

8. Acceptable use

You agree not to:

• Use Ponchos unlawfully, deceptively, or to violate another person’s privacy or intellectual-property rights.
• Access another account, bypass access or feature controls, probe vulnerabilities, or interfere with the service.
• Use automated means to scrape, systematically extract, reconstruct, or bulk-download Ponchos data or outputs without written permission.
• Resell, sublicense, publish, or use Ponchos data or outputs to create a competing database or service without written permission.
• Upload malicious code, overload the service, or use outputs to harass, discriminate against, profile, or make consequential decisions about another person.
• Misrepresent your identity, the source of information, or Ponchos’s relationship to you.

9. Credits and payments

Ponchos does not currently offer live paid checkout to customers. Credits and complimentary or trial access are internal access mechanisms, have no cash value, and are not transferable or redeemable. Restricted Stripe sandbox testing does not create a right to a paid plan or production service.

Before enabling customer purchases, Ponchos will present the applicable price, billing period, renewal, cancellation, refund, and tax terms and will update these Terms and the Privacy Policy as needed. No purchase will be created solely by your acceptance of these Terms.

10. Ponchos materials and permitted use

Ponchos and its licensors retain their rights in the service, software, design, branding, selection and arrangement of content, and other protected materials. Underlying third-party information remains subject to the rights of its source or owner. AI-generated or factual material may not be exclusively protectable.

While your account remains authorized, Ponchos gives you a limited, personal, non-exclusive, non-transferable, revocable right to use the service and its outputs for your own career research. No other license is granted, and Ponchos reserves all rights not expressly granted here.

11. Suspension and termination

You may stop using Ponchos at any time. We may restrict, suspend, or terminate access for violation of these Terms, security or legal risk, abuse, nonpayment if paid service is later enabled, or discontinuation of the beta or service. Where practical, we will provide notice, but urgent action may be taken without advance notice.

Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will survive.

12. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, PONCHOS IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PONCHOS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT INFORMATION OR OUTPUTS WILL MEET YOUR NEEDS.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PONCHOS AND ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST INCOME, PROFITS, DATA, OPPORTUNITY, OR EMPLOYMENT, ARISING FROM PONCHOS OR RELIANCE ON ITS INFORMATION.

TO THE FULLEST EXTENT PERMITTED BY LAW, THEIR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO PONCHOS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID PONCHOS DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US$100. THESE LIMITS DO NOT APPLY WHERE LIABILITY CANNOT LAWFULLY BE LIMITED, INCLUDING ANY NON-WAIVABLE CONSUMER RIGHTS.

14. Governing law

These Terms are governed by California law and applicable United States federal law, without regard to conflict-of-law rules. This choice does not deprive a consumer of mandatory protections provided by the law of the consumer’s home jurisdiction.

15. Changes to these Terms

We may update these Terms as Ponchos changes. We will revise the date above and provide reasonable additional notice of material changes. Where law or the nature of the change requires affirmative acceptance, we will request it. Otherwise, continued use after the effective date of updated Terms constitutes acceptance.

16. General terms

If a provision is unenforceable, the remaining provisions remain in effect. A delay in enforcement is not a waiver. You may not assign these Terms without our consent; Ponchos may assign them in connection with a reorganization, financing, merger, acquisition, or sale of the service or related assets. These Terms and the Privacy Policy are the agreement between you and Ponchos concerning the service unless a separate written agreement expressly applies.
